  7. YOU MAY USE THE MAC CHANNEL PURSUANT TO THE TERMS BELOW ON A FREE BASIS. IF

  12. The Mac Channel License: 1 END-USER LICENSE AGREEMENT FOR THE MAC CHANNEL
  13. SOFTWARE, IMPORTANT- READ CAREFULLY: This End-User License Agreement
  14. ("EULA") is alegal agreement between you (either an individual or a single
  15. entity) and THE MAC CHANNEL for the software product identified above,
  16. which includes "online" or electronic documentation and may include
  17. computer software and associated media and printed materials ("SOFTWARE
  18. PRODUCT" or "SOFTWARE"). By installing, copying, or otherwise using the
  19. SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you
  20. do not agree to the terms of this EULA, you are not authorized to use the
  21. SOFTWARE PRODUCT. SOFTWARE PRODUCT LICENSE The SOFTWARE PRODUCT is
  22. protected by copyright laws and international copyright treaties, as well
  23. as other intellectual property laws and treaties. The SOFTWARE PRODUCT is
  24. licensed, not sold.GRANT OF LICENSE. This EULA grants you the following
  25. rights:

  27. 1. Systems Software. You may install and use one copy of the SOFTWARE
  28. PRODUCT on asingle computer. If  Storage/ Use. You may store or install a
  29. copy of the SOFTWARE PRODUCT on a storage device, such as a network server,
  30. used only to install or run the SOFTWARE PRODUCT on your other computers
  31. over an internal network; however, you must acquire and dedicate a license
  32. for each separatecomputer on which the SOFTWARE PRODUCT is installed or run
  33. from the storage device. A license for the SOFTWARE PRODUCT may not be
  34. shared or used concurrently on different computers.  License Pak.

  36. 2.    DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.  Limitations on Reverse
  37. Engineering, Decompilation, and Disassembly. You may not reverse engineer,
  38. decompile, or disassemble the SOFTWARE PRODUCT, except and only to the
  39. extent that such activity is expressly permitted by applicable law
  40. notwithstanding this limitation.  Separation of Components. The SOFTWARE
  41. PRODUCT is licensed as a single product. Its component parts may not be
  42. separated for use on more than one computer.  Rental. You may not rent or
  43. lease the SOFTWARE PRODUCT. If the SOFTWARE PRODUCT is an upgrade, any
  44. transfer must include all prior versions of the SOFTWARE PRODUCT.
  45. Termination. Without prejudice to any other rights, T HE MAC CHANNEL may
  46. terminate this EULA if you fail to comply with the terms and conditions of
  47. this EULA. In such event, you must destroy all copies of the SOFTWARE
  48. PRODUCT and all of its component parts.

  50. 3.    UPGRADES. If the SOFTWARE PRODUCT is an upgrade from another product,
  51. whether from THE MAC CHANNEL or another supplier, you may use or transfer
  52. the SOFTWARE PRODUCT only in conjunction with that upgraded product, unless
  53. you destroy the upgraded product. If the SOFTWARE PRODUCT is an upgrade of
  54. a component of a package of software programs that you licensed as a single
  55. product, the SOFTWAREPRODUCT may be used and transferred only as part of
  56. that single product package and may not be separated for use on more than
  57. one computer.

  59. 4. COPYRIGHT. All title and copyrights in and to the SOFTWARE PRODUCT
  60. (including but not limited to any images, photographs, animations, video,
  61. audio, music, text, and"applets," incorporated into the SOFTWARE PRODUCT),
  62. the accompanying printed materials, and any copies of the SOFTWARE PRODUCT,
  63. are owned by THE MAC CHANNEL or its suppliers. The SOFTWARE PRODUCT is
  64. protected by copyright laws and international treaty provisions. Therefore,
  65. you must treat the SOFTWARE PRODUCT like any other copyrighted material
  66. except that you may either (a)make one copy of the SOFTWARE PRODUCT solely
  67. for backup or archival purposes, or (b) install the SOFTWARE PRODUCT on a
  68. single computer provided you keep the original solely for backup or
  69. archival purposes. You may not copy the printed materials accompanying the
  70. SOFTWARE PRODUCT.

  72. 5.    DUAL-MEDIA SOFTWARE. You may receive the SOFTWARE PRODUCT in more
  73. than one medium. Regardless of the type or size of medium you receive, you
  74. may use only one medium that is appropriate for your single computer. You
  75. may not use or install the other medium on another computer. You may not
  76. loan, rent, lease, or otherwise transfer the other medium to another user.

  78. 6.    U.S. GOVERNMENT RESTRICTED RIGHTS. The SOFTWARE PRODUCT and
  79. documentation are provided with RESTRICTED RIGHTS. Use, duplication, or
  80. disclosure by the Government is subject to restrictions as set forth in
  81. subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer
  82. Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of
  83. the Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as

  87. MISCELLANEOUS If you acquired this product this EULA isgoverned by the laws
  88. of the State of Texas. If this product was acquired outside the United States, then 
  89. local law may apply. Should you have any questions concerning this EULA, or if you 
  90. desire to contact The Mac Channel for any reason, please contact The Mac Channel,
  91. Austin, Texas.

  93. LIMITED LIABILITY: BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR
  94. ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE
  95. SOFTWARE PRODUCT, EVEN IF THE MAC CHANNEL HAS BEEN ADVISED OF THE
  96. POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES AND JURISDICTIONS DO NOT
  97. ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR
  98. INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
